A pool business in Cartersville, GA settled with Georgia Department of Transportation (GDOT) for $750,000. By condemning two-thirds of the site, including all of the display area, GDOT’s condemnation would have left the site unfit for continued use as a high-end commercial retail facility. Evans and Rhodes, LLC negotiated on behalf of its client and reached the settlement after GDOT filed the Declaration of Taking, which immediately transfers title to GDOT. In response, Evans and Rhodes, LLC filed a petition to set aside. After months of back and forth, Evans and Rhodes, LLC negotiated the settlement granting the business $750,000 for the loss of the property.
